Recordings do not lock tuner if not sceduled ahead of time

I have noticed that if I record a show that is in progress, and someone tries to watch tv on an mvp, the tuner that is recording a show is used for the live show thus causing my recording to have the wrong content.
I have noticed that this occurs when the recording takes place on tuner #4 rather than number 1.

another Issue I have found when recording shows that are currently being watched, is that the show never finishes recording and I end up filling the drive that the "live" tv directory is on.

attached are logs. the one show that did not lock the tuner was ECW scheduled while in progress on Tuesday the 5th i think at 9. the channel was changed at around 9:30.

The instance where the drives filled up occurred on sunday/monday around midnight. one of the shows was family guy, the other was something on discovery HD (channel 1617).

Any help would be much appreciated.

I also hbad this error last night which resulted in no recording and required me to restart the recording service.
