Currently if a tuner is in use in another program and npvr tries to use that tuner it records a 0 byte file. Could it instead realize the tuner is in use, not record a 0B file and look for a repeat of the program and record it?

ANY channel that is flagged copy-once can not be watched/recorded via NPVR. Windows Media Center is the only program that I'm aware of that contains the Cable Labs DRM code to allow those channels to be tuned.
