I actually have one of those. I was a little disappointed when I hooked it up. It is a serially controlled tape deck ( which is cool ) but it just feeds the sound to the line-in of your soundcard. I thought it might have an onboard DSP and plug into a USB port, putting out mp3's directly instead of relying on the soundcard to encode it.

Nah, you aren't being a prick at all. We are public, non-commercial educational institution. We read the following in the license:

"THIS LICENSE AGREEMENT FOR GB-PVR ("LICENSE AGREEMENT") IS A LEGAL AGREEMENT BETWEEN YOU (EITHER ON BEHALF OF YOURSELF AS AN INDIVIDUAL OR ON BEHALF OF AN ENTITY AS ITS AUTHORIZED REPRESENTATIVE)"

"You agree that the GB-PVR software will not be used for commercial purposes with full written permission. Any such forbidden use shall immediately terminate your license to the software. "

So we took the first part to mean that the agreement could be between "YOU[ meaning me Smile ] (EITHER ON BEHALF OF YOURSELF AS AN INDIVIDUAL OR ON BEHALF OF AN ENTITY AS ITS AUTHORIZED REPRESENTATIVE)" and Menten Holdings to mean that one person could enter into the agreement on behalf on an entity. In this case the entity is a non-commercial public institution. Since we aren't using it for any commercial purpose, since we are a state funded non-profit educational institution, we assumed we fit the second phrase. Most free non-opensource software makes an exception for non-profit and educational use. We assumed that since we were in all other ways fully compliant with the license, we were ok.

Our university's lawyers require us to submit all licenses agreements through them to make sure that we aren't binding the University to some outrageous license and to make sure that we aren't violating any licenses. They thought we were ok and that we fit that wording.

It could very well be that our use fits the absolute legal interpretation. Sometimes there is boilerplate text in these licenses and unless you wrote the whole thing yourself, you may not have noticed that phrasing or thought it could be interpreted that way. But if we are violating the intent or spirit of the license then we need to work something out. Please feel free to send me a private message or email me. We do not want to be in violation and will either stop using the program as soon as possible or work with you to bring us into compliance.

What you're describing certainly doesnt sound like 'personal, non-commercial use' to me. At the very least it violates the spirit of the license.
