ATI has a cable card ready tuner, that they sell to OEM manufacturers but not to the public, i see that some people are selling them on Ebay

what are the chances this will work with gbpvr, although it is only Vista compatible and i dont have vista

The chances are zero! I have been testing these for Microsoft for almost 2 years now (have 2 external tuners) and as you say, only OEM's are selling them. GBPVR doesn't even see them. AFAIK, only Vista Media Center will work with them.
Be careful what you buy. These units require special firmware and even the BIOS of the computer makes a big difference.
EDIT: I'm not sure but since ATI makes these tuners for Dell, Sony and others, they may actually have software that will work with the OCUR tuners but I don't think that it would be for sale either.

too bad, so sad, i hope one day down the line a company will just step up to the plate and stand up to MS, oh well till that day!! Atleast there's GBPVR

In this case, Cable Labs is the bad guy, not MS. All the restrictions were required to get Cable Labs' approval.
