Just tried to schedule a recording which NPVR won't allow and displays the conflict dialog- from Npvr log:

2012-12-25 18:23:55.380 [DEBUG][5] TV Listings: Unable to schedule recording 'Record Once, [7566263] Top of the Pops: 1978 (c_7359, 04/01/2013 21:50 - 22:50)', probably because there is no capture source available.

It's when I try to add the second Top of the Pops 1978 [see attached image]
If I use the default guide instead of TV Listings that won't allow it either though it doesn't log anything about the supposed conflict.

I've a dual tuner and the HD channels are all on one multiplex and obviously both TOTP are on an another so it should work [ the shows I want are Red ].

I found that if I delete 8 out of 10 Cats then add the second TOTP 1978 I can then add 8 out of 10 Cats back again without the conflict appearing.
So looks like NPVR "free tuner logic" needs a slight adjustment?

the way it works is that the first tuner is set to record the first Top of the Pops. Then because of the overlap, the second tuner is set to record 8 Out of 10 Cats. Then at 22:30, all tuners are free, so the first tuner is set to record The Graham Norton Show. NPVR is doing exactly what it is supposed to do, following tuner priority in each timeslot. Now you come along and ask it to record the second Top of the Pops which overlaps both 8 Out of 10 Cats AND The Graham Norton Show. Even though both of those shows *could* be recorded with a single tuner, they're scheduled on different tuners because of the timing and order the recordings were scheduled. Therefore no single tuner is available for the entire duration of the new show you're asking to be recorded.

Fixing this would not be a 'slight adjustment', but a whole new layer of logic that would have to re-evaluate all future recordings and re-allocate their tuner assignments. Then additional logic would be required to handle the situation where because of the change some future recording becomes impossible. This is a big mess that sub has understandably (to me anyway) opted not to tackle thus far.
