I think if I am right you are responsible for getting the imbedded CC enabled automatically in Kodi nightlies.

I just had to come here after updating and seeing it working. Thank you so much.

Is there still any hope that if there are two subtitle streams it will default to the second one?

I did have a PR for closed captioning added a few years ago. Did you try to change the default through the Kodi settings while the channel plays. In the US it might be useful to default to cc2 because that is often Spanish but in Canada it is often empty.
