After a bit of investigation I have found out something interesting, when I use the TS mux the decoder used is always the one specified as the AC3 encoder even though the audio is never AC3 for UK terrestrial tv. Obviously there is a problem with the AC Filter that I have specified but the important quetion is why is it using this filter???

It always tries to hookup the three types of audio that it might encounter on a channel, so that you can change to a channel with a different type of audio, without having to stop the graph and rebuild everything. These extra audio decoders are never delivered anything unless you switch to a channel with that type of audio.

The thing is though, if I switch off mpeg audio support (spdif passthrough) in the AC3 filter I get no audio so it is definitely using it for mpeg audio, surely that is not the intention?

No, that wasnt an intended goal, but its obviously difficult to make a one-size-fits-all solution. The scheme works well for most people, but may cause unexpected problems like this for some users.

I seem to remember some other thread discussing this, and the user had either switched to ffdshow for getting their spdif working, or tweaked some AC3Filter settings to disable certain audio types - I cant remember the exact details.

I have just noticed that if I leave the audio to get worst it gets to the point were the silence is longer than the sound and then the video is also pausing so perhaps it is nothing to do with the audio filter after all. But... I am still confused about the AC3 filer as above and also since I am using the MPV decoder which I have always used and I understand you recommend, where could the problem lie?
