Sure, I think that is what is happening, but that does not explain why gbpvr does *not* mark the section as a commercial (in the timeline, that is), but still treats it as one (with regard to skipping it)... and I'm usually able to skip into "non-ending" commercials if I want to - but not these ones...
Below is the comskip file for one of these. It seems it marks the last section - all the way to the last frame - as being a commercial, right?
